The Indianapolis man accused of murdering an eight-year-old boy will stand trial October 13. But he'll face a separate jury before that.
Listen:
Joshua Germany, 27, had already been accused of attacking his ex-girlfriend when he allegedly opened fire on her northside apartment last Wednesday. He faces up to 10 years on charges of choking Deneen Williams, a few days before the gunfire which killed her son Jeremiah.
"Previously, we've had a few cases where we filed charges (against Germany) and then she didn't cooperate, and we had to dismiss," says Marion County chief trial deputy David Wyser. "There were also a couple where the police had gone out on a run there, and she was uncooperative and no charges were actually filed. We believe this time, though, she is actually cooperating."
Wyser says Germany will go before a jury September 24 in the abuse case.
Prosecutors accuse Germany of trying to gun down Deneen Williams and her new boyfriend. Instead, the bullets killed Jeremiah Williams and wounded two other children in the apartment, including one of Deneen Williams' two children by Germany.
Court records say Germany told police it was Williams' boyfriend who was armed with the shotgun, and that it went off as the two of them struggled for it. Police claim that story doesn't match evidence at the scene.
Williams faces 45-to-165 years if convicted of murder and attempted murder. He's also charged with misdemeanor trespassing in a third case. Details of that incident weren't immediately available, but a judge has scheduled a pretrial hearing for September 9, the same day is a pretrial hearing in the choking case.
