Accused Deputy to Stand Trial in October

Paul WagnerA Marion County sheriff's deputy accused of demanding sex acts from a gas station customer will stand trial October 23.

Paul Wagner was arraigned Wednesday on charges of official misconduct and patronizing a prostitute. He's accused of repeatedly propositioning a customer at a gas station where he worked off-duty security. Offering something of value in exchange for sex creates a prostitution charge,even though prosecutors say Wagner's accuser is not a hooker.

Spokesman Mario Massillamany says the woman complained to police about Wagner's advances, and wore a wire on her next visit to the gas station. Investigators say Wagner was recorded offering the woman a pack of cigarettes and a soda to perform sex acts.

The misconduct charge involves an allegation Wagner told the woman he didn't have to pay for anything because he was a police officer.

Wagner declined comment. He said in court Sheriff Frank Anderson has suspended him.

Wagner faces up to four years in prison if convicted.
