Durham's Attorney Calls for Dismissal of Charges

Beleaguered businessman Tim Durham's attorney is asking a federal judge to dismiss the fraud charges against his client.

In a motion filed Wednesday morning, attorney John Tompkins accuses federal investigators of "outrageous" misconduct. Tompkins claims two calls were wiretapped four days before they were authorized by a federal judge.

"I don't think there's any greater intrusion on the privacy--and insult to the law--than law enforcement breaking the law," said Tompkins.

Durham is accused of stealing more than $200 million from investors in his failed firm Fair Finance.

The government has two weeks to respond to the motion. Durham is scheduled to stand trial next year.
