UPDATE: Judge Puts Hold On Order to Remove Secretary of State

Charlie White hires new attorney to handle appeal

Indiana's Secretary of State has a new man helping him fight for his job, and a little more time in which to fight.

Charlie White's new attorney asked for and received a hold on a judge's order from Thursday that White be removed from office. Marion Circuit Court Judge Louis Rosenberg put his order on hold until next Thursday, December 29, so he can hold a hearing sought by White's new attorney in the case, Jonathan Sturgill.

Rosenberg's order reversed a unanimous decision from the Indiana Recount Commission in June, as the judge said the Republican was ineligible to run for Secretary of State because of questions about his residency. The judge ordered the commission to certify Democrat Vop Osili as the winner of the 2010 race, even though Osili just won a seat on the city-county council.

State Attorney General Greg Zoeller, who in his capacity represents the Recount Commission, had said he would seek a stay and would ask the state supreme Court to consider the case, but his office was beaten to the punch by White's personal lawyer.

Many state Democrats, including party chairman Dan Parker, have called on White to step down so Osili can take office immediately. White, however, says he isn't going anywhere.

This case is separate from another criminal case in which White faces seven felony charges, including voter fraud.  That case is scheduled to go to trial January 30.
