An Indianapolis man is accused of operating his ice cream truck while under the influence of alcohol in Mooresville.
Police said they received a tip from a woman on Saturday that a man who appeared to be intoxicated was selling ice cream from a truck near White Ash Court. The officer responding to the call said he found a Summer Song Ice Cream truck being driven by Clarel Padgett, 58.
Investigators said the officer stopped the vehicle because it had an expired license plate. While talking to Padgett, the officer noticed his eyes were glassy and bloodshot, and that he was slurring his speech. The officer also said he smelled the odor of alcohol coming from inside the truck.
Police said a woman, identified as Mary Mansfield, was also inside the truck and appeared to be intoxicated. According to the police report, Padgett and Mansfield told the officer they had not been drinking.
Padgett was given a field sobriety test, followed by a Breathalyzer. Police said Padgett blew a 0.19 percent on the breath test, which is over the legal limit of 0.08 percent.
Padgett and Mansfield were charged with public intoxication and taken to the Morgan County Jail, officials said.
