A settlement has been reached in civil lawsuits filed against suspended IMPD Officer David Bisard, IMPD and the city of Indianapolis.
Corporation Counsel for the city Samantha Karn says a $1.55 million settlement was reached, but the settlement remains before a probate court for approval. Karn explained how the estate will receive the money saying, "to be paid out in two separate payments and the first payment will be made on July 2nd, 2012, and that's a million dollar payment." The second payment of $550,000 will be made on or before January 15th, 2013.
Karn says most, if not all, of the money will come from a legal defense fund set up by the city. Attorney for the estate, Hummel Coan Miller Sage & Rose LLC, says, "The basis for the gross negligence allegation was that Bisard was intoxicated and driving recklessly at high speed to a non-emergency he was not even dispatched for, while also using his in-vehicle computer for non-police business."
The Indianapolis Department of Public Safety said last month that its internal investigation foud no criminal intent on the transfer of a vial of blood central to the criminal case against Bisard. Prosecutor Terry Curry says the criminal trial will be held next year at the earliest.
