The prosecution submitted more email and telephone wiretap evidence that shows Durham and partner James Cochran in a desperate search for money.
Testimony by FBI agent Dennis Halliden also revealed the men were constantly plotting ways to stave off concerned investors and Ohio state regulators they believed might be suspicious about possible bad loans.
Wiretapped calls between Durham and Cochran also reveal the two discussing how to shirt the state's $250 million cap on investment certificates issued to investors.
In short, prosecutors are trying to show that in 2009, Durham and Cochran were doing whatever they could to stay afloat financially, including bilking thousands of investors through a Ponzi scheme. Durham and partners are charged with wire and securities fraud.
