Tim Durham's attorney John Tompkins officially says they plan to appeal Durham's conviction on twelve felony counts of conspiracy, wire and securities fraud.
However, Tompkins says they must first get through Durham's detention hearing Monday. Tompkins says he must also prepare for the sentencing hearing that will follow. Tompkins says they have 30 days following the sentencing date to file an appeal. Tompkins says he and Durham discussed the possibility of a conviction before the actual verdict so Durham was somewhat prepared.
However, he says the verdict hit Durham's family hard and they're stunned. The jury bought the prosecution's argument that Durham and partners Jim Cochran and Rick Snow bilked 5000 investors in a $200 million Ponzi scheme.
