Judge Rules in Favor of Doctor in Birth Defects Case

A Northwest Indiana doctor didn't have to disclose abnormal prenatal tests to a couple looking to adopt a baby from Gary.

The Indiana State Court of Appeals ruled that Victor and Lynell Jeffrey, from New York, didn't have a right to know about the tests before the adoption went through. According to the Jeffrey's attorney, Robert Montgomery, the couple has spent a fortune on medical bills since the adoption went through in 2006.

The sonogram showed severe brain development problems and other issues. The 3-0 appeals court decision said the Jeffrey's request for medical records didn't meet state privacy laws, so the doctor didn't have to release the information.

Montgomery says he's already considering taking the case to the Indiana Supreme Court.
