Recipients of Tainted BP Gasoline Have Legal Options

Now that BP has recalled tainted gasoline in Northwest Indiana, what are the options for those who put that gas in their cars?

Dean James Nehf with the IU Robert H. McKinney School of Law says BP is liable for physical damages to cars, but not necessarily for things like lost time or inconvenience. He says the question is quantifying what those damages are. Damages would include any costs involved with flushing out the gasoline and cleaning fuel systems along with any damage to engines.

Nehf says under a federal statute that governs breaches of warranty, BP may have to pay attorney fees which would be more of an incentive for attorneys to take these cases. He adds that BP could also be liable if any cars are devalued by the damage involved with using the tainted gasoline, but that will be something an attorney would need to investigate.
