A Marion County Criminal Court judge has ordered that testing of the blood vials in the David Bisard case take place in the Marion County Crime Lab.
This after attorneys debated issues regarding a Texas laboratory that had been set for DNA and toxicology review. Deputy Prosecuting Attorney Denise Robinson argued they needed a qualified toxiocologist to conduct the testing. Attorneys revealed the cost would've reached upwards of $15,000. Lab costs would've included the price of shutting down the entire lab to accommodate independent testing done in confidence.
Bisard's attorney John Kautzman argued his client would've had to carry some of the cost. He also questioned what the process might involve. Both sides would've had their own toxicologists and specialists on site. Ultimately, the judge ordered both sides to arrange to have testing done at the Marion County Crime lab. Both sides will have toxicologists and experts present to review the process.
Robinson says it'll take upwards of three weeks to secure a qualified toxicologist to oversee the process in Indiana. Kautzman has argued that in the past, blood samples weren't properly handled. Bisard is accused of hitting a group of motorcyclists while drunk and killing one man and hurting two others back in August 2010. The judge set another - attorneys only - hearing for Thursday, October 11th at 3 pm. At that time, they'll determine progress made in the case.
