A former Fort Wayne Catholic school teacher continues her lawsuit against the church. Emily Herx was fired after undergoing in-vitro fertilization procedures.

A medical procedure the Bishop who presides over the diocese calls, an intrinsic evil...now an ACLU attorney, Jennifer Lee says the diocese is maneuvering to dismiss the case before Herx can present any evidence to the court.

The Equal Employment Opportunity Commission ruled in her favor in January. Herx is infertile, a condition that is covered under the Americans with disabilities act. The diocese offered no comment, given the pending lawsuit.
