The Marion County Prosecutor's office is asking the court for permission to seek a life sentence for 21-year-old Jose Cruz who is charged with the murder of his girlfriend's three-year-old daughter.  Police say the little girl was beaten to death because she had soiled herself. 

An initial hearing is set for October 24th.  The prosecutor must show a least one aggravating factor.  In this case, two are being alleged--torture of the victim and her age.
