A defense attorney for Tim Durham is objecting to a recommended 225 year prison sentence for the convicted financier.
The attorney has filed a response to the pre-sentencing recommendation and the order that Durham should pay nearly $209 million in restitution. Durham scammed about 5,000 investors. The defense claims the sentence should be lower because he claims the amount lost by the victims was overstated. The attorney is also arguing that federal authorities caused some of the losses in the raid of Fair Finance in 2009.
The 38-page objection was filed Wednesday afternoon. Durham, James Cochran and Rick Snow were convicted of wire fraud charges in June. They are set to be sentenced on November 30th.
