John Kautzman, the attorney representing IMPD officer David Bisard, says he's disappointed at Curry's decision to re-file DUI charges against his client.

Bisard faces charges in connection with an incident last summer when he crashed his patrol car into a group of motorcyclists, leaving one person dead and two others seriously injured.

Kautzman says he thinks the issue has already been looked at and decided previously.

"Obviously, the new prosecutor feel that he wants the court to rule, even though we think it's absolutely clear under the statute that the charges should not stand and that the blood draw evidence is inadmissible.", said Kautzman.
