Driver in Fatal Crash Facing Six Felony Charges

The Noblesville woman involved in a fatal crash on the city's northeast side late Saturday night now faces six felony charges.

The crash occurred shortly before 10:30 p.m. in the 9000 block of Fall Creek Road which left 50-year-old David Foster and 28-year-old Whitney Miller dead and another, 49-year-old Marsha Foster, seriously injured.

Court documents say a Cadillac SUV driven by 22-year-old Paige Byers was heading southbound on Fall Creek when it crossed the center line and collided head-on with a northbound Ford Explorer driven by David Foster.  He and Miller were pronounced dead at the scene while Marsha Foster was taken to Eskenazi Hospital with multiple facial fractures and lacerations.

Byers had a blood-alcohol content of .10.  She told police she had five shots of alcohol and half of a beer before 8:00 p.m. and went to her boyfriend's house and fell asleep.  She said she woke up and had an argument with her boyfriend which led her to go for a drive to clear her head, according to court documents.

Byers now faces four counts of Operating a Vehicle While Intoxicated Causing Death and two counts of Operating a Vehicle While Intoxicated Causing Serious Bodily Injury.
