An Indiana University law professor believes a resolution could come by the end of this year for the case involving Indianapolis Metropolitan Police Department officer David Bisard. The judge in the case announced Thursday that he is withdrawing and has selected Allen Superior Court Judge John Surbeck Jr. to take jurisdiction.
Indiana University - McKinney School of Law Professor Lahny Silva doesn't think the venue change will impact the process. She says, "When judges feel that a trial is going to be held in an atmosphere that has been quotation utterly corrupted by press coverage quote,quote, they tend to want to move the case to a venue where the defendant will get a fair trial."
Silva says the guarantee of a fair trial really boils down to the impartiality of jurors. "So when you move a trial and the judge goes with the trial, then you're really seeing the purpose of the change of venue was to guarantee the impartiality of a fair trial. It's OK if a juror knows a little about the case. But they have to be able to lay aside these impressions or opinions which may have been influenced by press coverage of the case."The first hearing in Allen County is scheduled for March 8 at which time a trial date could be set.
