A judge says a vial of blood taken from suspended IMPD Officer David Bisard can be used in his reckless homicide and drunk driving trial.
The vial that will be allowed was the first vial of blood taken from Bisard after his police car slammed into three motorcycles on August 6, 2010. One rider was killed, and two others were hurt. That vial showed that Bisard had a blood alcohol level of .19 at the time of the crash.
The drunk driving charges were initially dropped by former Marion County Prosecutor Carl Brizzi after it was determined the person who drew the blood sample was not authorized to do so. They were reinstated by Brizzi's successor, Terry Curry. Defense attorneys had tried to have the vial thrown out, but the state court of appeals ruled that the blood was admissible. A judge in Allen County, where Bisard's trial was moved due to pre-trial publicity, upheld the use of the blood in his ruling.
Bisard is in jail after his bond was revoked following another drunk driving arrest earlier this year.
