A federal judge ruled Monday that Martinsville schools must allow a transgender student at John R. Wooden Middle School to use the boys’ restroom.

Judge Pratt stated in that ruling that the district failed to prove it would suffer “irreparable harm” by permitting the student to use the boys’ restroom.

“This speculative harm is both unsupported by any evidence and appears questionable, given that the School District allows other transgender students to use the restrooms associated with their gender identity,” wrote Judge Pratt in the ruling.

The judge also noted that the student at the center of the controversy has already been using the boys’ restroom for three weeks.

Martinsville schools said it will appeal the decision.

Meanwhile, a new poll shows Americans are increasingly against teaching children about gender theory in schools, while 64% of voters don’t believe transgenderism is a healthy human condition.

Here are the results of that new poll by Summit Ministries and McLaughlin & Associates:

  • 36% believe transgenderism is a healthy human condition.
  • 72% do not believe elementary schools should teach about sexual identity and sexual behavior.
  • 90% say minors should be required to wait until they are legal adults before undergoing permanent gender alteration, compared to 10% who say minors should be encouraged to undergo gender alteration.
  • 90% say medical professionals performing gender alteration procedures should be required by law to reveal the long-term medical and psychological impact of each procedure — 10% disagreed.
