A leaked draft opinion obtained by POLITICO shows the Supreme Court is poised to overturn Roe. v. Wade, a 1973 decision that guaranteed federal protection of abortion rights.
The majority draft opinion, written by Justice Samuel Alito, states “Roe was egregiously wrong from the start,” later writing that the Court holds that Roe V. Wade must be overturned.
The document further states: “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”
The draft does not guarantee that Roe V. Wade will ultimately be overturned.
POLITICO notes that “Justices can and sometimes do change their votes as draft opinions circulate.” Further, “major decisions can be subject to multiple drafts and vote-trading.”
Chief Justice John G. Roberts Jr. confirmed Tuesday that the leaked draft opinion is authentic, but not final, according to the Washington Post. He said he is opening an investigation into how it became public.
“To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed,” Roberts said in a statement. “The work of the Court will not be affected in any way.”
