COLUMBUS, Ohio. — The man who is accused of raping the 10-year-old girl who came to Indiana for an abortion last month is pleading not guilty.

Gerson Fuentes is charged with two counts of felony rape. The girl he’s accused of raping became pregnant and since Ohio has banned abortions after six weeks of pregnancy, the girl came to Indiana to have an abortion performed by an IU Health doctor.

The not guilty plea comes after police say Fuentes admitted to raping the girl back on July 12th.

Police are still waiting for DNA test results to come back. Fuentes is still in jail on $2 million bond.

The case has gained global attention as details emerged that the child had to travel to Indiana to get an abortion after the Supreme Court overturned Roe v. Wade. After the court’s decision, abortion as early as six weeks into pregnancy became illegal in Ohio because of a trigger law passed by the state legislature.

The case has also led to Attorney General Todd Rokita investigating Dr. Caitlin Bernard, who is the doctor who performed the abortion. Rokita is looking into whether Bernard followed the proper procedure in reporting the abortion and abuse to authorities.

The investigation has led Bernard to file a tort claim against Rokita, threatening a defamation lawsuit for comments he made on the case on national TV if he continues.
