INDIANAPOLIS--Shortly after Indiana Attorney General Todd Rokita said he would investigate a doctor who provided an abortion to a 10-year-old rape victim from Ohio, court documents released this week show that she did report it to the state.

It shows that Dr. Caitlin Bernard reported the abortion July 2, which was two days after the abortion was performed and within the three days required for terminations to be reported to the Department of Child Service and the Indiana Department of Health. Bernard also said the girl suffered from child abuse.

“My heart breaks for all survivors of sexual assault and abuse. I am so sad that our country is failing them when they need us most. Doctors must be able to give people the medical care they need, when and where they need it,” said Bernard on Twitter earlier this week.

Police arrested Gerson Fuentes, 27, and charged him with one count of rape. After the arrest, a Telemundo reporter spoke to a woman who identified herself as the girl’s mother. The woman told the reporter “everything they are saying against him is a lie.” She also said she did not file criminal charges against Fuentes. The decision to press criminal charges is up to the state. Fuentes is being held on a $2 million bond in Ohio.

Investigators say Fuentes is an illegal immigrant from Guatemala. Indiana Attorney General Todd Rokita told Fox News this is an example of President Biden’s lawlessness at the border..

“Then we have the rape. Then we have this abortion activist acting as a doctor with a history of failing to report,” said Rokita.
