(INDIANAPOLIS) – Yorktown’s clerk-treasurer can keep her job, despite not balancing the town’s books for four straight years.

The Indiana Court of Appeals ruled Beth Neff could be kicked out of office under a law allowing the removal of officials who neglect their duties. But a unanimous Supreme Court says that law needs to be used only in extreme situations. And while it calls Neff a particularly close call, the justices say she did perform other duties — just not that one.

An audit found errors in the town’s accounts totaled $3 million, with some entries too high and others too low. It cost the town $70,000 to clean up the mess.
