Appeals Court to Hear Obamacare Arguments

If the appeals court upholds an earlier ruling, protections for people with pre-existing conditions would be wiped out.

 

NEW ORLEANS -- The U.S. Court of Appeals will hear a challenge in the Affordable Care Act Tuesday that could threaten the entire law. 

Obamacare has come under frequent legal challenge since it was passed in 2010. 

The Supreme Court had ruled that charging a fine for people who aren't insured was a tax and therefore Constitutional. 

But Congress repealed that fine in 2017 and a lower court ruled that invalidated the entire law. 

The ruling was stayed pending appeal. 

If the appeals court upholds the ruling, 20 million people could lose insurance coverage and protections for people with pre-existing conditions would be wiped out. 

In that case, Obamacare would most likely end up back before the Supreme Court.
